JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-05-2016 Heard learned counsel for the petitioners and the learned Additional Public Prosecutor, appearing on behalf of the State. This application for grant of anticipatory bail arises out of Pirbahore P.S.Case No. 65/2016, disclosing offences under section 448, 143, 341, 323, 427 and 379 of the Indian Penal Code. The informant is the daughter of petitioners no. 1 and 2. Petitioners no. 3 and 5 are their sons, whereas petitioner no.4 is wife of petitioner no.3 and petitioner no.6 is wife of petitioner no.5.

The informant claims that she is legally married to Avinash Kumar, which is being opposed by the present petitioners. The allegation against the petitioners is that they

No.19333 of 2016 (2) dt.18-05-2016 assaulted her and attempted to create pressure on her for her second marriage in the court premises where she was to appear in the court of the learned Chief Judicial Magistrate. Learned Senior counsel, appearing on behalf of the petitioners, has submitted that being the father and mother of the informant, they always kept in mind the informant's welfare. It was never their intention to cause any harm to her. Considering the genesis of occurrence and the nature of accusation against the petitioners, this application is allowed. Let the petitioners, abovenamed, in the event of their arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in Pirbahore P.S.Case No. 65/2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C.

This is subject to the condition that the petitioners shall present themselves before the police/ court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
