JUSTICE PRABHAT KUMAR JHA ORAL ORDER 08-03-2017 Learned counsel for the petitioners seeks permission to withdraw the prayer for anticipatory bail of petitioner No.1, Ajit Yadav.

Prayer is allowed.

The prayer for anticipatory bail of petitioner No.1 Ajit Yadav is dismissed as withdrawn.

Heard both sides.

The petitioner no.2 apprehends his arrest in Rajpur P.S. Case No. 92 of 2016 registered under Section 307 and other sections of the Indian Penal Code.

The prayer for anticipatory bail was earlier rejected vide order dated 24.11.2016 passed in Cr. Misc. No. 43902 of

Patna High Court Cr.Misc. No.8275 of 2017 (2) dt.08-03-2017 2/2 2016. Therefore, I do not find any fresh ground to consider the prayer for anticipatory bail of petitioner No.2, which is rejected. If the petitioner No.2 surrenders in the court below and makes prayer for regular bail, the learned court below shall consider the regular Bail petition of the petitioner No.2 taking into consideration that similarly situated co-accused persons have already been granted anticipatory bail and, if possible, the same shall be disposed of preferably on the same day.
