JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but only suspicion has been raised against him in written report. Admittedly, the victim was found missing on 14.03.2014 and a Sanha was lodged on the same day in respect of missing of the victim but present case was lodged on 20.03.2014. Furthermore, it is obvious from perusal of the record that just after institution of the present case, the victim was found near the railway track and thereafter, his statement was recorded. The victim stated in his statement that on the alleged date of occurrence, he took tea at the instigation of Munna and thereafter he lost his consciousness. The victim further stated that the
Patna High Court Cr.Misc. No.3620 of 2015 (4) dt.21-04-2015 2/2 petitioner was also present with Munna at the time of alleged occurrence.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Muzaffarpur in connection with Kazi Mohammadpur P.S.Case No. 95 of 2014.
