The petitioner seeks bail in Begusarai Town P.S. Case No. 79/2018, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and section 27 of the Arms Act.

F.I.R. is against three unknown accused who committed murder of husband of the informant.

It has been submitted that name of petitioner has surfaced in this case on the basis of confessional statement of one of the co-accused. Even in the confessional statement there is no specific allegation against the petitioner. Similarly situated coaccused has been granted anticipatory bail vide order dated

Patna High Court Cr.Misc. No.40058 of 2018 (4) dt.17-09-2018 2/2 28.06.2018 passed in Cr. Misc. 32749/2018.

Petitioner is in custody since 15.02.2018.

Considering the fact that similarly situated co-accused has been granted anticipatory bail by this court, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 79/2018.
