JUSTICE BIRENDRA KUMAR ORAL ORDER 06-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

As per the FIR, there is discrepancy of three bags and odd of the wheat which the vehicle of the petitioner was carrying and allegation is that the petitioner has committed offence under Section 7 of the E.C. Act.

Learned counsel for the State has opposed the prayer for bail.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the

Patna High Court Cr.Misc. No.15082 of 2017 (2) dt.06-04-2017 court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati at Gaya/Successor Court in connection with Barachatti (Mohanpur) P.S. Case No.263 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
