JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-08-2019 This is an application for grant of anticipatory bail in connection with University P.S. Case No. 44 of 2018, disclosing offences under Sections 406, 409, 467, 468, 420, 120B, 34 of IPC.
Prosecution case is that during the evaluation of the mark sheets by a special team, there was some irregularities and tampering of marks and as such, an enquiry was conducted and in the enquiry explanation of the petitioner was not found satisfactory.
Submission of the learned counsel for the petitioner is that the enquiry report is at Annexure A and nothing specific has been attributed against him and specific allegation against other accused who is also a Professor, against whom there is specific allegation of irregularities, has been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court, vide
Patna High Court CR. MISC. No.53548 of 2019(2) dt.27-08-2019 2/2 order dated 26.08.2019 passed in Criminal Misc. No. 53107 of 2019.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-VIII, Muzaffarpur, in connection with University P.S. Case No. 44 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to appear before the I.O. during the investigation, otherwise his bail bonds shall be cancelled.
