====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 31-08-2018 Heard learned counsel for petitioner and learned counsel for the State.

Petitioner, who is in custody, seeks bail in connection with Giriak P.S. Case No. 189 of 2018 registered for the offences punishable under Section 414/34 of the Indian Penal Code.

Informant who is a police officer in his written complaint has stated that on 16.05.2018 when he was on patrolling with other police party at about 3:00 A.M. a silver colour Bolero bearing No. JH-01 AQ3610 stopped and from which four persons including petitioner came out from it and were apprehended by police in presence of two independent witnesses. It has been alleged that they do not have any paper relating to the said vehicle and thereafter seizure list was

It has been submitted on behalf of the petitioner that he is innocent and he has been falsely implicated in this case. He has no concern with the seized Bolero and he was not on the said vehicle. It has been further submitted that one similarly placed co-accused has been granted bail by co-ordinate bench of this Court in Cr. Misc. No. 49504 of 2018 vide order dated 10.08.2018. He is in custody since 16.05.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- I, Nalanda at Biharsharif in connection with Giriak P.S. Case No. 189 of 2018.
