JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 15-02-2023 Heard learned counsel for the petitioners and learned A.P.P appearing on behalf of the State. The petitioners are languishing in custody in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 337, 338, 353, 186, 188 of the Indian Penal Code.

As per F.I.R, 373 named persons including the petitioners and 100 unknown persons restored to

Patna High Court CR. MISC. No.61589 of 2022(2) dt.15-02-2023 2/3 blockage of road and committed violence with the police party in protest of death of one person.

It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in this case. There is general and omnibus allegation against the petitioners. There is no specific overt act against the petitioners. The similarly situated co-accused have already been granted bail by a coordinate Bench of this Court vide order dated 06.12.2022 passed in Cr. Misc. No. 46002 of 2022. The petitioners are languishing in custody since 11.05.2022.

Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 4th, West Champaran at Bettiah in connection with Balthar P.S.
