JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 13-04-2015 Heard learned counsel for the petitioners and the State.

The petitioners apprehend their arrest in a case for the offence under Sections 323, 354, 379, 380, 427, 452, 504, 506 and 120B of the Indian Penal Code.

Learned counsel for the petitioners submits that in respect of the same occurrence, petitioner no. 1, who is brother of petitioner no. 2, has also lodged a case under Section 307 of the Indian Penal Code. He further submits that petitioner nos. 1 and 2 sustained serious injuries at the hand of the prosecution. I find that there is a case and counter case and petitioners too have sustained injuries.

In the circumstances, in the event of arrest or

Case no. 85 of 2014, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
