JUSTICE SATYAVRAT VERMA ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 13.11.2020, charge-sheet has been submitted in the case and has antecedent of five cases. Learned counsel for the petitioner submits that the informant alleges that four unknown accused intercepted the informant and looted his Scorpio vehicle.

Learned counsel for the petitioner further submits that the petitioner has been falsely implicated in the case based on his antecedents and the petitioner came to be arrested in

Patna High Court CR. MISC. No.68920 of 2021(2) dt.22-04-2022 2/3 Bhaktiyarpur P.S. case no. 182/2020 in which he was made to confess his participation in the present occurrence. The learned counsel further submits that confession made in police custody has no evidentiary value.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and his name transpired based on his own confessional statement, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Phulwaria P.S. Case No. 102/2020 with a condition that one of the bailors shall be the father of the petitioner, Praveen Bharti.

Ms. Roona, learned counsel who appears for the petitioner submits that in paragraph '1' of the bail application inadvertently instead of Phulwaria P.S. Case No. 102/2020, it has been typed as Begusarai P.S. Case No. 102 of 2020. It is further submitted that the learned Advocate-on-Record is getting married and as such four weeks time be granted for rectifying
