1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 366A, 376D, 120B, 511, 506 and 34 of the Indian Penal Code & Sections 4, 6, 8, 10, 12 POCSO Act.

3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that petitioners kidnapped her minor daughter aged about 15 years on 05.12.2022 in connivance with Asha and Upendra

4. Learned counsel submits that petitioners have been falsely implicated in the instant case by the informant on account of dispute relating to land. It is also submitted that petitioners and the informant are agnates. It is further submitted that victim came back and her statement was recorded under Section 183 BNSS, wherein she has stated that on the date of occurrence, the petitioners, who are son-in-law of her Chachi (Badi Maa) kidnapped her and used to assault and give food after 2-3 days, further on pretext of attending nature's call she fled and came to Chapra station. It is submitted that the statement of the victim as recorded under section 183 BNSS has been recorded in the order impugned. It is further submitted that the victim does not allege any sexual assault.

It is further submitted that from the statement of the victim, it is culled out that the petitioners and the informant are related but then the informant in the FIR did not disclose her relationship with the accused persons rather gave an impression that criminals had kidnapped the victim. It is next submitted that petitioners will not abscond rather will cooperate in the investigation to prove their innocence. It is also submitted that petitioners are not criminals.

5. Learned A.P.P. for the State opposes the prayer for

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Basantpur (Lakri Nabiganj) P.S. Case No.590/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) amit/- U T
