JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406, 420, 120B of the Indian Penal Code.
The prosecution case is that the informant on account of good relation with petitioner and his brother used to give loan for the purpose of business, agriculture and other purposes. It is alleged that on year prior to lodging of the case the informant demanded money from the petitioner and his brother but they evaded to face the informant.
It is submitted by the learned counsel for the petitioner that there is no proof of the loan given to the petitioner and his
Patna High Court Cr.Misc. No.19929 of 2016 (2) dt.05-05-2016 2/2 brother. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saran at Chapra in connection with Chapra Town P.S. Case No. 148 of 2016 (G.R. No. 1831 of 2016) subject to the conditions as laid down under Section 438(2) Cr.P.C.
