The petitioner is apprehending his arrest in connection with Paras Bazar P.S.Case No. 136 of 2016 registered for the offences punishable under Sections 47 and 54 of the Bihar Excise Amendment Act, 2016.
It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case and he has nothing to do with the land in which godown is situated, which is not of the petitioner and it has come during investigation that land belongs to some other person.
Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioners stating that the godown is of the petitioner, which is evident from the seizure list itself.
Patna High Court Cr.Misc. No.9921 of 2017 (4) dt.30-03-2017 2/2 Having heard both sides and in view of prima facie allegation, I am not inclined to grant anticipatory bail to the petitioners. Let petitioner surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order, preferably on the same day.
