JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-09-2019 This application, for grant of anticipatory bail, arises out of Sadar P.S. Case No. 281 of 2019 disclosing offences under Section 379 of the Indian Penal Code.

Prosecution case is that informant loaded maize total 32985 kilogram amounting to Rs. 5,93,730/-in the truck of the petitioner, thereafter, the truck disappeared, as such, he suspected the hands of the petitioner and the driver. Submission of learned counsel for the petitioner is that he has been made accused in this case only on the basis of suspicion and he is ready to abide by any condition imposed on him.

Heard learned A.P.P. also.

Having heard both sides, considering the submission,

Patna High Court CR. MISC. No.56622 of 2019(2) dt.06-09-2019 2/2 as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Sadar P.S. Case No. 281 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure with further subject to the condition that petitioner will cooperate in investigation and make himself available as and when required by the Investigation Officer otherwise, the bail bond of the petitioner will be cancelled.
