JUSTICE SANJAY PRIYA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Mahua P. S. Case no. 08 of 2017 instituted for the offence under Section 414 of the Indian Penal Code and 30 (A) of the Bihar Excise Act. It is alleged that informant received confidential information that petitioner has got one loaded truck of foreign liquor in his house and on such information the police party came to the house of the informant and found the truck standing there. The petitioner fled away and 3330 litres of foreign liquor was recovered and seizure list was prepared. The truck was also seized.

This Court does not find it a fit case for grant of anticipatory bail. Accordingly, prayer of the petitioner is rejected.

No.14525 of 2017 (2) dt.29-03-2017 2/2 However, petitioner may surrender in the court below, i.e., Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua P. S. Case no. 08 of 2017 and make prayer for regular bail which shall be considered on its own merit without being prejudiced by the order of this Court.
