The petitioners seek bail in Kotwali (Barari) P.S. Case No. 681/2017, instituted for the offences under Sections 302 and 34 of the Indian Penal Code.
It is alleged in the written report that the mother of
Patna High Court Cr.Misc. No.42810 of 2018 (3) dt.24-09-2018 2/2 informant had gone to State Bank at Mayaganj Hospital. When his mother did not return, he telephoned his mother on which she replied that she was along with his uncle Ramesh Hari and cousin brother Niranjan Hari. Later on her dead body was found lying in the said hospital.
Learned counsel for the petitioners has submitted that there is no any direct allegation against these petitioners in the written report. They are not named in the written report. Name of these petitioners has come on the basis of C.D.R. of one Bumbum Yadav and thereafter the police recorded the confessional statement of petitioners Mithilesh Hari and Gaurab Hari. Considering the aforesaid fact and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Bhagalpur in S.T. No. 202/2018, arising out of Kotwali (Barari) P.S. Case No. 681/2017, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J.) Rakhi U T
