This is the second attempt on behalf of the petitioner for grant of regular bail in connection with Athmalgola P.S. Case No.95 of 2023 registered for the offence punishable under section 8(c)/20(b)(ii)(B) of the N.D.P.S. Act. 3.
Earlier, the petitioner was granted regular bail by this Court vide order dated 21.03.2024 passed in Criminal Miscellaneous No.54319 of 2023 and directed the court below to verify the antecedent of the petitioner and if it is found that he has clean antecedent then his bail bonds shall be accepted by the court below.

Learned counsel for the petitioner submits that the petitioner had submitted that he has clean antecedent but subsequently, he has been found to be accused in one more
Patna High Court CR. MISC. No.63109 of 2024(4) dt.05-03-2025 2/2 criminal case and therefore, his bail bond was not accepted by the court below.

Considering the fact that the antecedent of the petitioner is not of a similar nature i.e. under the N.D.P.S. Act, this bail application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, XII, Patna/ concerned Court, in connection with Athmalgola P.S. Case No.95 of 2023. (Sandeep Kumar, J) pawan/- U T
