This application has been filed for transfer of case arising out of Baikunthpur P. S. Case No. 227 of 2014 from the Court of learned ACJM-III, Gopalganj to a Court of equivalent jurisdiction under the Judgeship of Chapra. The place of occurrence is evidently, within the jurisdiction of Gopalganj Judgeship, which is evident from the First Information Report.
The plea which has been taken for transfer of the case is that it will be for the general convenience of the parties and witnesses. It cannot be a ground for transfer of the case under Section 407 of the Code of Criminal Procedure, 1973.
This application has no merit and it is, accordingly, dismissed.
