The petitioner apprehends his arrest in Industrial P.S. Case no. 32 of 2013, registered for the offences punishable under Sections 307, 379 and other Sections of the Indian Penal Code. The petitioner is not named in the FIR. The name of the petitioner figured in the case in the statement of Kunal Kumar mentioned in para 7 of the case diary. Kunal Kumar disclosed that the petitioner also participated in the alleged occurrence. It is submitted that Mrityunjay Kumar is named in the FIR, but he has already been enlarged on anticipatory bail vide order passed in Cr. Misc. no. 52269/2013 on 7.03.2015. Other accused persons, namely Md. Hasim and Md. Jahir are named in

Patna High Court Cr.Misc. No.16880 of 2015 (2) dt.06-05-2015 2/2 the FIR have also been enlarged on bail.

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Industrial P.S. Case No. 32 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi/- U T
