2. The petitioner is in custody since 03.04.2016 in connection with Simri P.S. Case No. 31 of 2016 for the offences alleged under Sections 147, 149, 341,342, 323, 325, 307, 379 and 504 read with section 34 of the Indian Penal Code and Section 3(i)(iv)(x) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act.
3. It is submitted that the petitioner has been falsely implicated and in any event there is no allegation whatsoever against the petitioner to attract the offence under the provisions of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act. There is also no allegation of assault attributed to the petitioner. It is submitted that the accusation of having
Patna High Court Cr.Misc. No.21929 of 2016 (2) dt.19-05-2016 2/2 snatched the mobile phone of Guddu Paswan is merely ornamental. There is a case and counter case between the parties.
4. In the aforesaid facts let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of Sri Ravi Pandey, learned Judicial Magistrate, Ist Class, Darbhanga in connection with Simri P.S. Case No. 31 of 2016.
