The petitioner, who is in custody, seeks bail in connection with Nabinagar P.S. Case No. 47 of 2018 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 354, 435, 353, 332, 333, 379, 427, 504, 120(B) of the Indian Penal Code.
Informant is the police officer, who has stated that on 25.02.2018 at 5.00 PM, information was received in the police station that one child met an accident and he died on the spot and a mob of 300-400 people gathered near the place of accident and had blocked road and when police reached there the mob started throwing stones on the police resulting in
Patna High Court Cr.Misc. No.41349 of 2018(3) dt.16-08-2018 2/2 injury to police personnel.
It has been submitted that petitioner is innocent and has been falsely implicated in this case and allegations against petitioner is general and omnibus in nature. Petitioner has clean antecedent and it has been further submitted that similarly placed co-accused have already been granted bail by a different Co-ordinate Bench of this Court vide order dated 29.06.2018, 04.07.2018 and 10.07.2018 passed in Cr. Misc. No. 36193 of 2018, Cr. Misc. No. 38415 of 2018 and Cr. Misc. No. 40408 of 2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad, in connection with Nabinagar P.S. Case No. 47 of 2018.
