The petitioner, who is in custody, seeks bail in connection with Tikapatti P.S. Case No. 59 of 2018 registered for the offence punishable under Sections 376, 511 of the Indian Penal Code.
Informant is the victim herself, who in her written complaint has stated that on 20.04.2018 at about 10.30 PM when she went to sleep after taking meal, petitioner tried to commit rape upon her but on alarm being raised he fled away. She could recognize him in flash light of torch. It has been submitted by the petitioner that he has been falsely implicated as there were some dues against
Patna High Court Cr.Misc. No.39934 of 2018(3) dt.21-08-2018 2/2 mother of informant and when they went for dues there were hot talks between the parties and after one day the informant has instituted this case. It has been further submitted that petitioner has no criminal antecedent and he is in custody since 21.05.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Purnea, in connection with Tikapatti P.S. Case No. 59 of 2018.
