JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-09-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The statement of injured persons of this case have been recorded at para-75 and 76 of the case diary and one injured, namely, Vishwanath Yadav at para-75 of the case diary stated that it was co-accused, Rajendra Yadav, who gave tengari blow to the deceased causing head injury to him and after that co-accused, Ranjit Yadav assaulted the deceased with sword. So far as petitioners are concerned, omnibus allegation of assault has been levelled against the petitioners. Moreover, the statement of injured of this case does not reflect any specific overt-act against the

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Sadar P.S. Case No. 314 of 2014.
