JUSTICE SUDHIR SINGH ORAL ORDER 27-06-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Section 409 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons , as per direction of this Hon'ble Court, have not submitted the record with folder file for verification inspite of a number of letters sent by Koshang Nodel Officer cum Zila Programme Officer, Aurangabad.
It is submitted on behalf of the petitioner that he has got no criminal antecedent. He has falsely been implicated in the present case. Petitioner had joined the office of Panchayat Sachiv in the year 2013. Whatever documents, which were in possession of the petitioner, have already been handed over vide Annexure-3. It is evident that the documents which were not in possession of the petitioner regarding the same, he had intimated to the District Programme Officer. The other co-accused have been granted bail vide Cr. Misc. no. 24287 of 2016.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Patna High Court Cr.Misc. No.21431 of 2016 (3) dt.27-06-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Kuttumba P.S. Case no. 21 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
