The petitioner, who is in custody, seeks bail in connection with Andhratharhi P.S. Case No. 54 of 2018 (G.R. No. 597 of 2018) registered for the offence punishable under Section 392 of the Indian Penal Code.

Informant in his written complaint has stated that on 18.05.2018 at 5:15 P.M. while he arrived by his bike near the house of Md. Nazim after withdrawing Rs. 75,000/- for distribution amongst the members of consumer Seva Centre at Madna, he saw two persons on Apachi Blue coloured bike came from behind and touched the bike and took out the key from bike and snatched away a mobile and cash of Rs. 75,000/-. It has also alleged that miscreants also took away the Air bag

Patna High Court Cr.Misc. No.42288 of 2018(3) dt.10-09-2018 2/2 containing chequee book and other documents and he claimed to identity the miscreants by face.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. The F.I.R. has been lodged against unknown. Mobile has been recovered from the possession of the petitioner. Due to dirty village politics, the petitioner has been implicated in this false case. He is in custody since 21.05.2018 and he has no criminal antecedent. The dispute between the parties has been resolved. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Jhanjharpur, District- Madhubani in connection with Andhratharhi P.S. Case No. 54 of 2018 (G.R. No. 597 of 2018).
