The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 447, 325, 307, 379, 504, 506/34 of the Indian Penal Code. It is alleged that when the land of the informant was ploughed by the accused persons then father of the informant made protest and he was assaulted by accused persons, when brother of the informant went to rescue he was also assaulted. The accused persons assaulted grant-father of the informant. Specific assault with iron rod has been alleged, the injury caused to the grand-father of the informant is grievous in nature. It is submitted by learned counsel for the petitioner that except one grievous injury, caused to the grand-father of the
Patna High Court Cr.Misc. No.15895 of 2015 (2) dt.17-04-2015 2/2 informant, other injuries are simple in nature including the injury of the informant. There is counter version of the occurrence also.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Sasaram (Tillouthu) P.S. Case No.904 of 2014, pending before the Chief Judicial Magistrate, Sasaram.
With the above observation, this application is, accordingly, disposed off.
