JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-08-2017 Heard learned counsel for the petitioner, learned counsel appearing on behalf of O.P. No.2 and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Dulhin Bazar P.S. Case no. 117 of 2015, registered under Sections 498(A) and 494 of the Indian Penal Code.

Learned counsel for the petitioner submits that on the prayer of the parties, the matter was referred to the Mediation Centre, Patna High Court for settlement of dispute between petitioner and O.P. No.2, who are husband and wife. The dispute between the parties has been resolved through the process of mediation and they entered into an agreement, accordingly, both the parties decided to live separately and petitioner will paid Rs. 4000/- per month as maintenance to O.P. No.2 till the performance of her remarriage and both the parties will withdraw all cases filed between them. The children out of their

Patna High Court Cr.Misc. No.14759 of 2017 (4) dt.29-08-2017 2/2 wedlock will live with the O.P. No.2 and the petitioner shall have right to meet with the children. Since, the dispute between the parties has been resolved, the petitioner may be released on anticipatory bail. Learned counsel appearing on behalf of O.P. No.2 has no objection in allowing the pre-arrest bail of the petitioner as the petitioner and O.P. No.2 have settled the dispute entering in to agreement before Mediation Centre, Patna High Court, Patna. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-III, Danapur, Patna in connection with Dulhin Bazar P.S. Case No. 117 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
