JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-11-2022 At the outset, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail petition, so far as petitioners no. 1 & 3 namely Rekha Devi and Shila Devi is concerned.

Permission is accorded. The anticipatory bail petition, in respect of petitioners no. 1 & 3, stands dismissed as withdrawn.

The petitioners no. 2 & 4 apprehend their arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

Patna High Court CR. MISC. No.56205 of 2022(2) dt.18-11-2022 2/2 108 liters of Nepali liquor has been recovered from different sacks, which were thrown near Kundal Pokhra and it is alleged that same were thrown by these petitioners. It is submitted on behalf of petitioners that nothing has been recovered from the conscious possession of the petitioners and they have got no concern with the alleged recovery. Petitioners claim clean antecedent. Considering the nature of allegation and clean antecedent of petitioner, let petitioners no. 2 & 4 namely Rubi Devi @ Ruby Devi and Anita Devi, in the event of their arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Harlakhi P.S. Case No. 170 of 2022, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
