2. In this case, the petitioner is seeking regular bail in connection with Bairgania P.S. Case No. 99 of 2024, registered for the offences punishable under Sections 147, 149, 341, 448, 323, 324, 307, 379, 504, 506, 354 of the IPC.

3. As per allegation, the accused persons including the petitioner, equipped with country-made pistol, garasi, dab and iron rod came at the house of the informant. Co-accused Sadare Alam assaulted the informant's first nephew with butt of pistol on his head and co-accused Md. Alauddin Ansari assaulted informant's second nephew by means of country-made pistol on his head. Further, co-accused Tasleema Khatoon and Rubiya Khatoon dragged the informant by catching her locks and snatched

Patna High Court CR. MISC. No.63999 of 2024(2) dt.18-09-2024 2/2 her golden ornaments. When one Anil Mahto (staff of the informant) came to rescue her, he was also assaulted by this petitioner.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent. He has submitted further that the injuries sustained by Anil Mahto is simple in nature. There is case and counter case. The petitioner is under custody since 29.04.2024.

5. Considering the above-mentioned facts and circumstances as well as period of custody, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bairgania P.S. Case No. 99 of 2024, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
