The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 481.2 litres of IMFL was recovered from the pick-up van and the petitioner who was the driver of the vehicle was taken into custody. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession nor from the vehicle in question. He has been falsely implicated in the case. He is in custody since 14.09.2021 and has no criminal antecedent.

No.67592 of 2021(2) dt.27-04-2022 2/2 Having heard learned counsel for the parities and taking into consideration the recovery of 481.2 litres of liquor and the petitioner being the driver of the vehicle having been arrested at the spot, the Court is not inclined to enlarge the petitioner on bail and the application is rejected. Liberty is granted to the petitioner to renew his prayer for bail on completing one year in custody.
