JUSTICE BIRENDRA KUMAR ORAL ORDER 18-05-2017 It appears that the petitioners were allowed anticipatory bail by order, dated 04.05.2017. However, due to typographical negligence, the order has been typed as follows :
"Let this matter be listed before some other Bench after obtaining necessary orders of the Hon'ble the Chief Justice".
The parties agree that on 04.05.2017, in fact, anticipatory bail was granted to the petitioners, which is as follows :
"Heard the learned counsel for the petitioners and the State.
This is a petition for grant of anticipatory bail for offence under Section 498A of the Indian Penal Code.
Patna High Court Cr.Misc. No.12669 of 2017 (4) dt.18-05-2017 2/2 The husband is already in custody. The petitioners are mother and brother of the husband. The allegation of demand of dowry and torture for the same is general and omni bus.
Considering the aforesaid fact, the petitioners, above named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Complaint Case No. 83 of 2016 (Tr. No. 1870 of 2016) to the satisfaction of the Chief Judicial Magistrate, Gopalganj, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code."
