JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Ara Town P.S. Case No. 33 of 2013 registered for the offences punishable under Sections 467, 468, 471, 419, 420, 274, 275, 276, 120B of the Indian Penal Code, Section 27 (b) (ii) (a) (c)/ 28 (A) of the DNC Act, 2008 & Drugs & Magic Remedies (OA) Act, 1954 and Section 6 of Indecent Representation of Women (Prohibition) Act, 1986.

The only allegation against the petitioner is that her mobile number was published in an advertisement. The contention on behalf of the petitioner is that father in law of the petitioner runs a registered clinic and he had given mobile number of the petitioner and moreover, having more

Patna High Court Cr.Misc. No.1267 of 2015 (2) dt.13-01-2015 or less similar allegation, one co-accused, Jyoti Prabha has already been admitted to anticipatory bail by a co-ordinate bench of this court vide order dated 24.04.2014 passed in Cr. Misc. No. 14727 of 2014.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Ara in Ara Town P.S. Case No. 33 of 2013 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
