The petitioners apprehend their arrest in Dehri (T) P.S. Case No. 77 of 2016 instituted for the offence under Section 379 of the Indian Penal Code, Sections 4(1-a)/21(1) of Mines and Minerals D.E. Act, Section 40(1) of the B.M. Act and Sections 33, 41 and 42 of the Forest Act.

It is alleged that during raid by police at several places crusher machines were found for the purpose of illegal mining and on inquiry, the police learnt that petitioners were indulging in running of crusher machines for preparing the stone chips after illegal mining. The co-accused with similar allegation

Patna High Court Cr.Misc. No.7444 of 2017 (2) dt.23-02-2017 2/2 have already been granted anticipatory bail by Co-ordinate Bench of this Court vide Cr. Misc. No. 1692 of 2017 dated 19.01.2017. In the circumstances, prayer of the petitioners for anticipatory bail is allowed.

In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Dehri (T) P.S. Case No. 77 of 2016, they shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri, Rohtas, subject to the conditions as laid down under Section 438(2) Cr.P.C.
