This application, for grant of anticipatory bail, arises out of Sadar (Muffasil) Police Station Case No. 258 of 2016/ (G.R. P.S. Case No. 2272 of 2016) disclosing offences under Sections 302/201 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that the petitioner has not been named in the F.I.R. No. any witnesses during course of investigation have supported the implication of this petitioner in the alleged occurrence. Merely on the basis of suspicion, name of this petitioner and co-accused Ganesh Singh, who has already been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 44161 of 2016, have
Patna High Court Cr.Misc. No.9849 of 2017 (2) dt.10-03-2017 surfaced in this case. Moreover, final form, which is annexure-2, has already been submitted in this case. Hence, the petitioner deserves the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Sadar (Muffasil) Police Station Case No. 258 of 2016/ (G.R. No. 2272 of 2016) subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
