====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 29-11-2024 Heard Mr. Ranjan Kumar Jha, learned counsel appearing on behalf of the petitioner and Mr. Shailendra Kumar Singh, learned APP for the State.
2. The petitioner seeks pre-arrest bail in connection with Bihpur (Bhawanipur) P.S. Case No. 651 of 2023, registered for the offence punishable under Sections 341, 323, 354(B) and 307 of the Indian Penal Code.
3. As per the allegation made in the FIR, petitioner, who is the uncle of the informant, had misbehaved with the informant.
4. Learned counsel appearing on behalf of the petitioner submitted that petitioner is innocent and has falsely been implicated in the present case. He further submitted that informant and petitioner are agnate and due to family dispute,
Patna High Court CR. MISC. No.60165 of 2024(2) dt.29-11-2024 2/3 the petitioner has been implicated in a false case. No such incidence as alleged in the F.I.R. has ever taken place. Wife of the petitioner, namely, Bebi Devi, who is also co-accused in the present case, has already been released on pre-arrest bail by this Court vide order dated 26.06.2024 passed in Criminal Miscellaneous No. 37742 of 2024. On these grounds, petitioner seeks to be released on pre-arrest bail.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

Considering the nature of allegation made in the F.I.R., as well as, the fact that the wife of the petitioner, namely, Bebi Devi, who is also co-accused in the present case, has already been released on pre-arrest bail by this Court vide order dated 26.06.2024 passed in Criminal Miscellaneous No. 37742 of 2024. the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his/her arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Naugachia, Distt. - Bhagalpur, in connection with Bihpur (Bhawanipur) P.S. Case No. 651 of 2023 , subject to the condition as laid down under
