This Criminal Miscellaneous has been filed to modify the order dated 12.01.2017 passed in Cr. Misc. No. 845 of 2017 on the ground that the petitioner could not surrender within four weeks as he has fallen ill and was under treatment and medical report has been annexed. In the facts and circumstances stated above, again the petitioner is directed to surrender before the learned court below in connection with Khagaria P.S. Case No. 358 of 2016 within four weeks from the date of receipt/production of a copy of this order and then, he shall be released on execution of bail bonds on the terms and condition as per order dated 12.01.2017 passed in Cr. Misc. No. 845 of 2017. In the result, this application for modification is allowed. (Jitendra Mohan Sharma, J) avin/- U T
