JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-03-2017 The petitioner is apprehending his arrest in connection with Sirdalla P.S. Case No. 208 of 2016, registered for offences punishable under Sections 420, 409 and 34 Indian Penal Code. It has been submitted on behalf of the petitioner that so far allegation of allotment for the period of 2008-09 is concerned, the account was handled by the committee and not by the petitioner and so far allegation for the financial year 2011-12 is concerned, out of Rs. 2,45,816/- he has already spent an amount of Rs. 1,55,800/- for construction of school building and an amount of Rs. 18,816/- is still in account and whatever unexplained amount is there, he is ready to pay back the same. Heard learned A.P.P. also.
Having heard both sides, in view of the submissions of
Patna High Court Cr.Misc. No.11803 of 2017 (2) dt.21-03-2017 2/2 learned counsel for the petitioner, let petitioner surrenders before the Court below along with a Demand Draft of Rs. 72,000/- drawn in favour of the authorities concerned and the court below after verifying the said demand draft shall release the petitioner on bail furnishing bail bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of like amount each to the satisfaction of learned ACJM-V, Nawada in connection with Sirdalla P.S. Case No. 208/2016 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
It is made clear that the deposit of above amount shall be subject to final result of the case.
