JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-04-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 304B/34 of the Indian Penal Code.

Petitioner who happens to be the husband of the deceased is alleged to have beaten the sister of the informant who died during treatment.

Learned counsel for the petitioner denies the allegation and submits that the doctor who treated the deceased found no injury on the external part of the body. Petitioner is in custody since 17.5.2021.

Learned counsel for the State opposes the prayer for bail and submits that there is specific allegation against the petitioner that he had beaten the sister of the informant and

Patna High Court CR. MISC. No.67279 of 2021(3) dt.18-04-2022 2/2 locked her in the room and it was informant who took her to the hospital where she died during treatment. Besides this, post mortem report reveals that there was a injury on the neck of the deceased which caused her death.

Considering the rival submissions of the parties and the fact that the petitioner is the husband of the victim who was allegedly assaulted by him at his house causing her death, prayer for bail is refused.
