Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 21.8.2017 passed in Cr. Misc. No.39011 of 2017 with observation to conclude the trial within a period of nine months.

Submission of the learned counsel for the petitioner is that up-till-now only two witnesses have been examined and there is no likelihood to conclude the trial in near future. Heard learned A.P.P. and from perusal of the report, it appears that out of 11 witnesses, 04 witnesses have been examined and three are non-government and one government witnesses.

Having heard both sides and in view of the facts and

No.41534 of 2018 (3) dt.08-08-2018 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it as soon as possible, if possible to conduct it on regular basis. At the same time, the S.P., West Champaran is directed to ensure presence of the witnesses. With the aforesaid observation, this application is dismissed.
