====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 04-09-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks regular bail in connection with Muffasil Motihari P.S. Case No. 405 of 2023, lodged on 03.06.2023, under Sections 399/402 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act.
3. Learned counsel for the petitioner submits that the bail application of the petitioner was earlier rejected vide order dated 08.11.2023 passed in Cr. Misc. No. 59014 of 2023 with liberty that he may renew his prayer for bail after framing of charge. Counsel submits that charge has already been framed on 24.07.2024. Counsel further submits that he is in custody since 04.06.2023 and there are three criminal cases pending against the
Patna High Court CR. MISC. No.59828 of 2024(2) dt.04-09-2024 2/2 petitioner in which he is on bail in some cases and in some cases he is persuading for bail.
4. Learned counsel for the State opposes the prayer for bail and submits that criminal antecedent of the petitioner is not clean but he also accepts that charge has already been framed.
5. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on being satisfied by the trial Court that the petitioner is not absconding in any of the cases pending against him whose details are mentioned below, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, in connection with Muffasil Motihari P.S. Case No. 405 of 2023, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
