The petitioner is accused in connection with Town P.S. Case No. 422 of 2014 registered under sections 420/34 and 138 of the N.I. Act pending in the Court of S.D.J.M., (West), Muzaffarpur.

Submission is that petitioner is innocent and has committed no offence as alleged in the F.I.R. He has falsely been implicated in this case. It is also submitted that petitioner has got no criminal antecedent.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that petitioner has committed fraud with the informant and there is

Patna High Court Cr.Misc. No.9801 of 2017 (5) dt.21-08-2017 2/2 direct allegation against him.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. (Arvind Srivastava, J) Shailendra/- U T
