In this case the petitioner is challenging order taking cognizance dated 23.7.2015 passed by learned Judicial Magistrate, 1st Class, Patna by which cognizance has been taken under Sections 406, 420, 120B/34 of the Indian Penal Code.

As per allegation made in the First Information Report, someone has stealthy taken Rs. 1 lac.

This matter cannot be looked into at this stage and it can only be taken at appropriate stage.

With the aforesaid observation, this application is dismissed.
