JUSTICE SANJAY PRIYA ORAL ORDER 24-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bikramganj P.S. Case 111 of 2018 instituted for the offence under Sections 25(1-b), a, 26 and 35 of the Arms Act.
Counsel for the petitioner submits that petitioner has clean antecedent. He is in custody since 6.4.2018. It is alleged in the written report that police got confidential information that illicit liquor has been kept hidden in Dalan of one Ajeet Singh. The police went to testify the aforesaid information. On seeing the police party 3-4 persons started running away. The petitioner was arrested along with other coaccused persons as mentioned in the written report. It is further alleged that one loaded country made pistol and two live
Patna High Court Cr.Misc. No.41832 of 2018 (3) dt.24-09-2018 2/2 cartridges were recovered from possession of the petitioner. It is mentioned in paragraph-3 of the bail petition that petitioner has clean antecedent.
Keeping in view the period spent by the petitioner in custody, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bikramganj, Distt. Rohtas, in connection with Bikramganj P.S. Case No. 111 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
