JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 409, 120(B), 188, 201 of the Indian Penal Code.

The prosecution case is that in view of order passed by this court in CWJC No. 15459 of 2014 all the Panchayat Secretaries were directed to submit complete folder of the employed Panchayat teachers so that the Vigilance department may examine the same. The said folders were to be submitted by 15.02.2015 failing which FIR was to be lodged against concerned Panchayat Secretary.

It is submitted by the learned counsel for the petitioner that the petitioner submitted the folder to the Block Development

Patna High Court Cr.Misc. No.20173 of 2016 (2) dt.06-05-2016 2/2 Officer well within time on 03.07.2015, the receiving of the same has been brought on record as Annexure-2 but maliciously FIR has been registered. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the nature of accusation coupled with the fact that petitioner has got no criminal atecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Jamui in connection with Khaira P.S. Case No. 44 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
