JUSTICE SANJAY PRIYA ORAL ORDER 6/ 25-10-2018 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Jogapatti P.S. Case No.346 of 2017 instituted for the offence under Section(s) 302 and other allied sections of Indian Penal Code pending in the Court of the 1st Additional Sessions Judge, Bettiah, West Champaran. It is alleged in the written report that son of informant had eloped with daughter of this petitioner for which the petitioner had given threat to the informant's son of dire consequence.
It is further alleged that on the date of occurrence while the son of the informant was sleeping on the Machan at the door, the petitioner along with other accused, as named in the written report, came and took him to their house and assaulted him brutally with lathi, danda after pressing his mouth and tying his hands and legs.
Patna High Court Cr.Misc. No.42962 of 2018 (6) dt.25-10-2018 2/2 petitioner and other accused to spare his son, but they continued to assault him brutally and thereafter he died. Dead body was found in the Aangan of the petitioner.
Counsel for the State as well as Informant submits that doctor has found several injuries on the person of the deceased caused by hard and blunt substance.
Postmortem report also supports that son of informant was brutally assaulted on account of which he died. In such circumstances, this Court is not inclined to enlarge the petitioner on bail.
Prayer of the petitioner for grant of bail is rejected at this stage.
From the report of the Court below, it appears that Charge has been framed in the case on 10.04.2018. Petitioner is said to be in custody since 17.09.2017.
The Court below is directed to expedite the trial by giving short adjournments in the case and make all efforts to conclude the trial as early as possible, preferably, within a period of nine months from the date of receipt of copy of this order. (Sanjay Priya, J) JA/- U T
