No. 1 of 2023 has been filed for expunging the name of respondent No. 5, Gangadhar Prasad Singh, who died on 26.03.2023 during the pendency of this case and whose sons are already on record of this case as respondent Nos. 9, 10 and 11.

3. Considering the averments made in the I. A. No. 1 of 2023, the same is allowed.

4. Heard learned counsel for the parties.

5. Learned counsel for the petitioner prays for directing the Circle Officer, Sonepur (Respondent No. 3) to get the land of the petitioner measured with regard to Khata No. 34 and 51, Plot No. 424/125, 997/1357 Area 9 Kattha 16 Dhurs 2 Dhurki situated in Mauza- Parwezabad under Sonepur Anchal of Saran District.

By way of filing counter affidavit, counsel for the State submits that an application was filed by the petitioner before respondent No. 3 wherein he requested to get the land appertaining to Khata No. 31, 151, Plot No. 424, 1257/ 992, 1357 measured. The petitioner also deposited the fee of Rs. 1500/- of Anchal Amin vide Reciept No. 431517 dated 24.08.2022.

7. In view of the facts and circumstances of the writ application, respondent No. 3 is directed to measure and demarcate the land of the petitioner in accordance with law, preferably, within a period of six months from the date of receipt of copy of this order.
