JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 26-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Singhia P. S. Case No. 151 of 2014 registered under Sections 302 and 201/34 of the Indian Penal Code.

It is contended by the learned counsel for the petitioners that other co-accused, namely, Kusheshwar Prasad Singh and Prem Kumari whose case is identically situated to that of the petitioners, have already been granted pre-arrest bail by a coordinate Bench of this Court vide order dated 14.08.2015 passed in Cr. Misc. No. 32610 of 2015 as contained in Annexure- 2 to the

Patna High Court Cr.Misc. No.21530 of 2016 (2) dt.26-05-2016 2/2 present application.

Learned counsel for the State has not disputed the aforesaid contention of learned counsel for the petitioners. Regard being had to the reasons assigned in the aforesaid order dated 14.08.2015, in the event of arrest or surrender before the court below within six weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in Singhia P. S. Case No. 151 of 2014, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
