JUSTICE ARUN KUMAR ORAL ORDER 06-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody seeks bail in Nautan PS Case No. 487 of 2017 registered under Sections 363, 366A, 376 of the IPC and Section 4 of the Pocso Act.

Learned Counsel for the petitioner submits that the girl of the informant is major, she herself stated her age 19 years and the Medical Board has found her age 16 - 17 years, her statement recorded under Section 164 Cr.P.C. reflects that she eloped with the petitioner voluntarily and married with him.

Having considered the said facts and circumstances, the petitioner, namely, Vijay Ram @ Vijay Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I -cum- Special Judge Bettiah, West Champaran in connection with Nautan PS Case No. 487 of 2017.
