The petitioners seeks bail in Barauni P.S. Case No. 83 of 2018 registered for the offence punishable under Sections 147, 149, 353, 354, 332, 447, 427, 307 and 506 of the Indian Penal Code and Section 3 of Public Property Damage Act. Informant is the Headmaster of the School who in his

Patna High Court Cr.Misc. No.41641 of 2018(3) dt.18-08-2018 2/3 written complaint has stated that petitioners along with 10 unidentified miscreants came to the School on 09.03.2018 at about 12:15 pm looking for Laxman Pasawan one of the teachers in the School and thereafter started abusing and assaulting teachers of the School. Allegation against the petitioners are of assaulting informant by rod. Allegation against Sambhu Paswan is of assaulting by knife and Neel Kamal Paswan is by rod on the back of the informant. Allegation is also of assault on teacher Deepak Kumar and also outraging the modesty of female teachers and using filthy language and also causing damage to the furniture kept in the School. It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case.

All the petitioners are full brothers and they have lodged FIR against one of the teacher Laxman Paswan for outraging the modesty of daughter of petitioner no. 1 Bibikshan Paswan. It has been further submitted that petitioners have got no criminal antecedent. Petitioner nos. 1 and 2 are in custody since 21.05.2018 and petitoner no. 3 is in custody since 01.06.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bonds of Rs.

Patna High Court Cr.Misc. No.41641 of 2018(3) dt.18-08-2018 3/3 two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni P.S. Case No. 83 of 2018.
