JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Muffasil P.S. Case no. 134 of 2016, registered under Sections 420, 406 and 379/34 of the Indian Penal Code.

The accusation is that on receiving secret information about unloading the milk to the milk tanker in two other vehicles near Laxmi Hotel at N.H.31, the Police reached there and apprehended three persons, who disclosed their names as Chandan Kumar, Ajay Kumar and Navlesh Kumar, who are the drivers of their respective vehicles. The milk was extracted from Milk Van Tanker bearing Reg. No. UP-13N-9979 with the help of motor and pipe and the milk was filled in Drum and Tank kept on two Pick up Vans bearing Reg. No. BR-01GD-4551 and BR-52A-9958.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.16520 of 2017 (3) dt.09-05-2017 2/2 apprehended persons claimed that they are driver of the said vehicle. Further submission is that petitioner is the owner of Milk Tanker bearing Reg. No. UP-13N-9979 and he was not apprehended on the spot. The petitioner is only owner of the said milk tanker and he has falsely been implicated in this case. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawadah in connection with Muffasil P.S. Case No.134 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
